Assembly Floor Alert - ACA 14 UC - Contracting OPPOSE

The American Staffing Association and California Staffing Professionals oppose ACA 14
(Ortega) which would amend the Constitution to unnecessarily restrict the ability of the
University of California to contract for services needed to ensure fulfillment of the
University’s education, research, and healthcare mission.

The UC system already strictly follows state public contracting laws and many of the
collective bargaining agreements they have with their unions place limits and safeguards
on UC contracting.

However, UC campuses still rely on contract workers for assignments that are infrequent,
highly specialized, or fill critical staffing vacancies. Nowhere is this more important than
when it involves the UC healthcare system. Hospitals and medical centers cannot
provide needed services unless they are adequately staffed, and for many facilities that
often require access to temporary healthcare professionals. These professionals can
address staff absences, including vacations, sick leave, and parental leave, as well as
assisting a hospital in increasing the number of staff to deal with a surge in patients. By
denying this necessary flexibility, ACA would place many vulnerable Californians in
jeopardy.

Finally, by impeding UC’s use of staffing firms, the legislation would deny jobs to many
temporary and contract workers who enjoy the flexibility that such work offers and the
opportunity to work in peak seasons or to fill in for employee absences. These workers
also would be denied the “bridge” that often leads to permanent employment.
We respectfully request a NO vote on ACA 14.
